These Terms of Service (“Terms”) govern your access to and use of PlaySweepstakes.com (the “Site”), operated by PlaySweepstakes.com (“we,” “us”). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. The Site Is Free

We do not charge for access to the Site, we do not sell entries, and we never require a purchase or payment of any kind to enter a giveaway that we sponsor. If any person or website asks you to pay a fee in order to enter one of our giveaways or to claim a prize from us, it is not us. Report it to giveaways@playsweepstakes.com.

2. Third-Party Promotions

Most listings on the Site are informational summaries of giveaways, sweepstakes, and contests operated by other companies. We do not run those promotions, we are not affiliated with their sponsors, and we have no control over them. We do not select their winners, hold their prizes, or guarantee that any prize will be awarded.

Listing details such as deadlines, eligibility, and prize values are gathered from public sources and may be incomplete, out of date, or incorrect. The official rules published by the promotion’s own sponsor always control. Read them before you enter. Your dealings with any third-party sponsor are solely between you and that sponsor.

3. Our Own Giveaways

From time to time we sponsor our own giveaway. Each one is governed by its own separately published Official Rules, which control over these Terms in the event of any conflict. Our giveaways are open only to legal residents of the fifty (50) United States and the District of Columbia who meet the minimum age for their state, and are void where prohibited.

4. Acceptable Use

You agree not to: use any robot, spider, scraper, or other automated means to access the Site or to submit giveaway entries; submit false, misleading, or another person’s information; create multiple identities or email addresses to obtain additional entries; interfere with or disrupt the Site or its security; attempt to gain unauthorized access to any part of the Site or its systems; or use the Site for any unlawful purpose. We may suspend access and void entries for any violation.

5. Intellectual Property

The Site’s design, text, and original content are owned by us or our licensors and are protected by copyright and other laws. Product names, logos, and brands appearing in listings are the property of their respective owners, are used for identification only, and do not imply endorsement or affiliation.

6. Advertising

The Site is supported by advertising, including advertising served by Google AdSense. Advertisements are not endorsements. We are not responsible for the content of advertisements or for the products, services, or practices of advertisers. 7. Disclaimer of Warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any listing is accurate, complete, or current.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR YOUR PARTICIPATION IN ANY PROMOTION LISTED ON IT, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless PlaySweepstakes.com and its officers, directors, members, employees, and agents from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms or your misuse of the Site.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising out of these Terms or the Site will be brought exclusively in the state or federal courts located in that state, and you consent to their jurisdiction.

11. Changes

We may modify these Terms at any time by posting a revised version with a new “Last updated” date. Your continued use of the Site after a change takes effect constitutes acceptance of the revised Terms.
